Attorney Andy Biller is one of the few lawyers in Ohio that focuses his practice almost exclusively on wage and hour civil litigation. This includes class and collective actions for unpaid minimum wage, overtime compensation, worker misclassification, and wage theft. In addition, Mr. Biller handles employment and business law matters.

Most of Mr. Biller’s work involves representing employees in lawsuits brought in federal or state court. Typically, the legal actions are brought under the Fair Labor Standards Act (FLSA), Ohio’s minimum wage constitutional amendment (Article II § 34(a)), and Ohio’s Minimum Fair Wage Standards Act (OMFWSA). Attorney Biller also advises businesses and other attorneys on wage and hour issues.

Seeing a clear need, Mr. Biller has more recently expanded his practice to include liberty-oriented cases. This includes matters like police misconduct or excessive force, assaults on fundamental liberties like free speech or the right to keep and bear arms, and government abuse of power.

In Mr. Biller’s spare time, he enjoys playing board games of all sorts, going to the shooting range, and relaxing with his wife Beth and son Christopher. Attorney Biller is also a fan of cats, especially his own two, Maisie and Hobbes.

Representative Cases & Cases of Interest

Pandey v. Rascal Unit, case no. 2:09-cv-550 (Mr. Biller acted as lead counsel on behalf of an employee alleging worker misclassification, unpaid overtime wages, and the employer’s failure to keep wage and hour records. Mr. Biller was the first Ohio lawyer to successfully argue for and receive an award of fees for an employer’s failure to keep employee records as required by Ohio’s minimum wage constitutional amendment (Article II § 34(a)). Privately resolved.)

Yanni v. Red Brick Mortgage, case no. 2:07-cv-1260 (Mr. Biller acted as co-counsel on behalf of a class of mortgage brokers alleging unpaid overtime wages. This case was later cited in the Department of Labor’s opinion letter AI 2010-1. Privately resolved with one defendant and judgment of $85,997.66 against two other defendants.)


Eisel v. Fortney Companies, Inc., case no. 2:11-cv-298 (Mr. Biller acted as co-counsel on behalf of a class of restaurant workers alleging an illegal tip pool, unpaid minimum wages, and unpaid overtime wages. Privately resolved.)


Royster v. Gillen, case no. 2008-CI-0483 (Mr. Biller acted as co-counsel on behalf of four medical services employees alleging sexual harassment, gender discrimination, pregnancy discrimination, retaliation, assault, and battery. Privately resolved.)


Cassley v. Kanji Lancaster, Inc., case no. 2:12-cv-337 (Mr. Biller acted as lead counsel on behalf of a group of seven waitresses and bartenders alleging an illegal tip pool, retaliation, unpaid minimum wages, and unpaid overtime wages. Judgment of $23,191 plus attorney’s fees and costs.)


Wright-Parker v. Brenner, case no. 2:13-cv-1076 (Mr. Biller acted as lead counsel on behalf of a music teacher alleging unpaid minimum wages and overtime wages. Settlement of $11,000 plus $9,000 in fees and costs. The case was covered in the Columbus Dispatch.)
